Terms of Service.

Throughout these Terms of Service (the "Agreement") “we”, “us” or “our” refers to CCD Consulting LLC doing business as Careercoach.design, a career coaching consultancy (also referred to as the “Agency” on this website); and “you” or “your” and mentions of the “Client” means the person buying or using our services and resources. This Agreement sets forth the terms and conditions under which our services are offered, your relationship between you and your coach (the “Coach”) and use of our website, careercoach.design (the "Website").

Disclaimer

Services offered on this website are developed for strictly educational purposes. Due to the nature of the program and extent, the results experienced by each client may significantly vary. Coach makes no representations, warranties or guarantees verbally or in writing. Careercoach.design and Maria Pentkovski will make their best effort to provide guidance and advice in good faith and in the best interest of the client, however it is important to note that the coach cannot guarantee specific outcomes or results. In the rare event that the client experiences negative consequences as a result of following the coach's advice, the coach cannot be held liable for any monetary losses, damages, or other forms of liability. The results of career coaching are dependent on many factors, including the client's effort, commitment, and ability to implement the coach's recommendations. While following the coach's recommendations may increase the odds of success, the coach or use of this website cannot guarantee it.

Career coaching is a process where an experienced professional (Coach) provides guidance and support to Clients in order to help them identify and achieve their career goals. Career coach works with the client to assess their skills, interests, values, motivators, and experience, and provides guidance on how to improve their job search strategies, interview skills, resume writing, portfolio and career development. The goal of career coaching is to help individuals find meaningful work that aligns with their personal and professional goals, and to help them navigate the job market more effectively.

Coaching is self-regulated as opposed to government-regulated, the practice of coaching is broadly defined. For example, according to the ICF, “coaching is the future-focused practice of partnering with clients in a thought-provoking and creative process that inspires them to maximize their personal and professional potential. Professional coaching focuses on setting goals, creating outcomes, and managing personal change”. The IAC defines coaching as a “transformative process for personal and professional awareness, discovery and growth”. According to the ICF, a coach is responsible for discovering, clarifying, and aligning with what the client wants to achieve; encouraging client self-discovery; eliciting client-generated solutions and strategies; and holding the clients responsible and accountable for meeting goals and creating outcomes. For these reasons, coaching often relates to career development, achievement, and advancement.

Confidentiality

This coaching relationship, as well as all information (physical or verbal) that the client shares with the coach as part of this relationship, is bound by the principles of confidentiality. Careercoach.design will keep all personal details, compensation details, and any intellectual property discussed during coaching sessions confidential. The coach will not disclose any of this information to third parties without the client's express written consent. Client agrees to not share any content and coaching materials provided by the Careercoach.design and any coaches within the organization throughout the program.

BE ADVISED: the Coach-Client relationship is not a relationship protected by legal confidentiality (like doctor-patient or attorney-client). As such, the coach could be required to divulge otherwise confidential information to authorities.

Description of services

Careercoach.design provides career coaching services as described on this website. Clients agree to the terms of services as they sign up by scheduling a coaching session. The services provided may include career assessment, goal-setting, action planning, resume and portfolio review, interview preparation, salary negotiation and ongoing support.

Session options and prices

Careercoach.design offers various session options, including ad hoc hourly sessions, programs, packages, and memberships. The terms and prices of these sessions are subject to change at any time and without notice. Clients must observe the cancellation and refund policies stated for each session type.

Refunds

Ad hoc Sessions

Ad hoc sessions are refundable, provided the cancellation meets our policy requirements. If the Client requests a refund for ad hoc session, the refund amount will be calculated as follows:

For payments made by credit card, the refund will be issued to the same credit card used for the original payment.
The refund amount will include the total amount paid by the Client for the coaching services, minus any transaction fees incurred by Careercoach.design. These fees are calculated as 2.9% + 30¢ per transaction. Additionally there is a 1.5% fee for international cards and 1% fee for currency conversion per transaction.

Careercoach.design reserves the right to refuse a refund request if the request is made after the services have been completed or if the Client has violated the cancellation policy.

Programs and Packages

Programs and packages are non-refundable. No refund will be granted for any unused sessions included in any program or package. Please note that sessions included in programs and packages can be used within 365 days from the date of purchase, after which they are considered expired.

Memberships

Membership plans are non-refundable. If the Client chooses to end their membership, they can do it at any time after the initial 3 month commitment period, this will ensure no new membership fees are charged to the Client moving forward. It is important to note that there will be no refund issued for membership fees paid to date despite of membership cancellation, including for any unused sessions.

Cancellations

Ad hoc sessions, programs, packages and memberships have unique cancellation policies which you can review at the time of booking. Please make yourself aware of the cancellation policies before booking as they have direct impact on your ability to request a refund.

First free session

Careercoach.design offers a free initial session to all new clients. The session includes an initial introductory meeting outcome of which will be a high-level career strategy plan, answers to immediate questions, and guidance on next steps towards goal progression. However, the first session must be the first-ever meeting with the coach. If the client has already had a free meeting with the coach on another platform, they are not qualified for a free session to be booked through the website.

Tardy and No-Show Policy

Tardy is defined as the Client failing to join the session within 10 minutes of the scheduled start time. If the Client notifies their coach of their tardiness and cannot join within the described 10-minute timeframe, they will be advised to reschedule with their coach based on mutual availability. Failure to notify of tardiness results in session cancellation after 10 minutes, categorized as a 'no-show'. Two consecutive 'no-shows' lead to termination from the Careercoach.design platform, with no refund unless under special and extreme circumstances such as a health emergency or act of nature, subject to evaluation and potential reinstatement by the Company if the absence reason is deemed excusable.

‘Round the clock' support via Slack®

Careercoach.design's coaching packages and programs include round the clock (8am - 10pm PST) support via Slack® directly by their coach, with a maximum 12-hour reply window. This allows clients to receive ongoing support and guidance as they work towards their career goals.

Sharing resume and portfolio materials

Client agrees to allow Careercoach.design and Maria Pentkovski to share their case study deck and website for educational purposes to other clients and on careercoach.design website. This allows Careercoach.design and Maria Pentkovski to use real-life examples submitted by clients to help other clients better understand the content and design patterns to communicate and present their portfolio of past work and professional experience.

Marketing and advertising

Client agrees that any comments, feedback or reviews of services provided by Careercoach.design and Maria Pentkovski that are shared with the coach in any format, such as surveys, social media, text messages, or any other means of communication, may be used for marketing purposes on Careercoach.design website and related social media. This includes, but is not limited to, the use of client feedback in promotional materials, website content, and social media posts. If the client prefers not to be quoted, they must inform their coach. In this case, the quote may still be used publicly, but without attribution to the client. Instead, it will be sourced as anonymous.

Modification of terms

Careercoach.design and Maria Pentkovski reserve the right to modify these Terms of Service at any time without notice. Clients should regularly check the terms of service to ensure they are aware of any changes made.

Termination of services

Careercoach.design and Maria Pentkovski reserve the right to terminate their services to clients at any time for any reason, including a violation of these Terms of Service. If Careercoach.design and Maria Pentkovski terminate their services, clients will be refunded any unused portion of their coaching package as allowed per existing session/package/membership cancellation policy.

Governing law and jurisdiction

This line item means that this Agreement is governed by the laws of the state of California in which Careercoach.design is located, without regard to its conflict of law provisions. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the state or federal courts located in that state.

By using our Site and purchasing our services, you acknowledge that you have read and understood these Terms of Service and agree to be bound by them.
